Judge sides with Mizkif to continue lawsuit against Emiru but not Asmongold
Mizkif has released a video walking viewers through his defamation lawsuit against Emiru tras a judge denied her motion to dismiss.
Twitch streamer Mizkif has posted a new video titled “Emiru Lied, Part 1,” denying allegations made by his ex-partner Emiru and walking viewers through the current status of his defamation lawsuit against her.

Emiru, real name Emily Schunk, went live in October 2025 and accused Mizkif of psychological and domestic abuse, stalking and harassment, sexual assault, and threats of blackmail. Mizkif responded at the time and denied the allegations.

He later sued Emiru, Asmongold, OTK, Mythic Talent Management, and King Gaming Labs in the Western District of Texas, bringing claims including defamation and breach of contract. The lawsuit followed OTK's public support for Emiru and its confirmation that it had cut ties with Mizkif, though the organization said his termination occurred “some time ago” and was unrelated to the recent allegations.

Now, Mizkif has uploaded a 45-minute video going through the case filings and arguing that Emiru’s allegations are false.

“I deny those accusations completely,” Mizkif said at the start of the video. “I am the one who went to court. I sued her for defamation, meaning for making false accusations that damaged me.”
Mizkif denies Emiru’s allegations in new video
In the video, Mizkif focused heavily on Emiru’s October 2025 livestream, his own response, and a recent court recommendation in the case.
He argued that he never “admitted to everything,” denied sexually assaulting, abusing, or stalking Emiru, and claimed that clips of his original response were taken out of context.
Mizkif also pointed to a June 2026 report and recommendation from a federal magistrate judge, which recommended denying Emiru’s motion to dismiss the defamation claim against her.
However, the recommendation is not a final ruling on whether Mizkif’s claims are true, nor does it decide whether Emiru’s allegations were false. At this stage, the court was assessing whether the lawsuit had been pleaded sufficiently to continue.
In the report, the magistrate judge found that, considering the “gist” of Emiru’s statement, which included allegations of sexual assault, it was “reasonably capable of a defamatory meaning.” The court also said Mizkif had plausibly pleaded a defamation claim against Emiru based on the allegedly untrue statement involving sexual assault.
The magistrate judge also recommended that Mizkif submit a more definite statement within 30 days, identifying each statement from Emiru’s livestream that he alleges is defamatory, including exact quotes, how each statement is untrue, and how it harmed him.
Mizkif acknowledged that distinction in the video, saying the recommendation is “the court letting my case move forward, not a verdict.”
The same report recommended dismissing the defamation claim against Asmongold, also known as Zack Hoyt, without prejudice. It also recommended compelling arbitration and staying parts of the case involving OTK, Mythic, and King Gaming Labs.
