In a July 10 video titled “We’re Being Sued,” Callaghan revealed that Channel 5 has spent more than $800,000 fighting a federal lawsuit connected to its documentary Dear Kelly.

The film follows Kelly Johnson, also known as Kelly J. Patriot, after Callaghan encountered him at a White Lives Matter rally in Huntington Beach in 2021. It examines Johnson’s political radicalization and a long-running dispute involving the foreclosure of his home by private lender William Joiner.

Joiner filed a federal lawsuit against Callaghan, Channel 5, and several others on May 30, 2024. The complaint included allegations of federal wiretapping violations, privacy violations, and other state-law claims. Callaghan has denied wiretapping Joiner or recording his electronic communications.

Callaghan said forensic investigators examined Channel 5’s servers and hard drives during discovery but found no evidence that the company had wiretapped Joiner.

The federal case ended on May 19, 2026. Callaghan characterized the outcome as Joiner’s attorneys dropping their claims before trial, although court records show both sides entered a joint stipulation dismissing the case without prejudice.

The order required each party to cover its own legal expenses and specified that neither side would be considered the prevailing party.

However, Callaghan said he was served with another lawsuit on July 9, this time filed in California state court. According to the YouTuber, the new complaint contains modified allegations including defamation, stalking, false light, and trespassing.

“After speaking with a couple different attorneys, it doesn’t seem like the second round is going to be any cheaper than the first,” he said. “I can’t afford it. This is not a drill. We cannot afford to keep operations running here at Channel 5 unless we can immediately fundraise the legal fees.”

Callaghan has launched a GoFundMe with a goal of $800,000, matching what he says Channel 5 spent defending itself during the first case.

He explained that Channel 5 makes money through Patreon subscriptions, merchandise, and advertising rather than outside investment. Without enough money to continue fighting the case, Callaghan said the company would have to enter an indefinite hiatus.

That would involve closing its offices, laying off staff, and relying on passive Patreon revenue until the lawsuit concludes. Callaghan said the other option would be to sell part of Channel 5 to a corporate investor, which he argued would conflict with the company’s independent mission.

Channel 5 currently employs 10 full-time workers and operates a newsroom in México City. The company has also reacquired All Gas No Breaks and is developing a new independent documentary platform called C5.now.

“If we can’t reach our goal, we’re going to have to put everything on ice until this new lawsuit wraps up,” Callaghan said.
